In a landscape that reflects the rapid digital transformation, the UAE is at the forefront of efforts to combat digital piracy and protect intellectual property rights through an integrated strategy that combines advanced legislation and smart technologies, in a qualitative \u201cwar\u201d that faces the challenges posed by the digital age to creators and content creators.<\/p>\n
Quantum jump in the fight against piracy<\/p>\n
Blocking infringing sites in the country witnessed a quantum leap during 2024, with 4,557 violating sites blocked, compared to 1,123 in 2023, reflecting the great progress achieved by the UAE in the face of digital infringement and the protection of the intellectual rights of creators. These figures reflect the enormous weakness in operational capabilities built in a short period of time to address rising digital challenges.<\/p>\n
Insta Block. Smart weapon against piracy<\/p>\n
In a qualitative step, the Ministry of Economy and Tourism opened the InstaBlock Lab in Dubai Media City, which aims to enhance the speed of blocking sites that violate the intellectual property rights of works, by employing the latest artificial intelligence techniques used to address digital hacking and the immediate blocking of violating broadcasting sites.<\/p>\n
The laboratory, which works in cooperation with the Telecommunications and Digital Government Regulatory Authority (TDRA), is one of the Ministry\u2019s \u201cNew Intellectual Property System\u201d initiatives, which includes more than 30 initiatives aimed at enhancing the country\u2019s position in addressing any practice that violates intellectual property rights.<\/p>\n
H.E. Dr. Abdulrahman Al-Maini, Assistant Undersecretary for the Intellectual Property Sector at the Ministry of Economy, stressed that the laboratory contributes to \u201cestablishing the country\u2019s position in the indicators of combating digital piracy, and providing a secure digital environment that supports creativity and innovation.\u201d<\/p>\n
Strategic partnerships to protect digital content<\/p>\n
Insta Block Lab works through strategic partnerships with major regional and global media and digital platforms to coordinate joint efforts to ensure the protection of the intellectual rights of creators and producers of digital content. The most prominent of these partnerships are the cooperation agreements signed with the Trademarkers Council, Abu Dhabi Media, YANGO PLAY, STARZPLAY, and OSN.<\/p>\n
The opening ceremony also saw the signing of agreements with the La Liga (LALIGA), which had previously signed a memorandum of understanding with the Ministry of Economy to launch the Anti-Piracy Lab project.<\/p>\n
Dissidentive legislation and an advanced legal framework<\/p>\n
The UAE legal system for the protection of intellectual property is based on Federal Decree-Law No. 38 of 2021 on Copyright and Related Rights, which has made substantial improvements to the legal framework, including the criminalization of the storage of illegal copies of electronically protected works (Article 40).<\/p>\n
The penalties are provided for imprisonment and fines ranging from AED 10,000 to AED 1,000,000 for anyone who violates the economic or moral rights of rights holders, and criminal liability extends to those who change the information of the Digital Rights Department or deal in devices aimed at circumventing the technical measures of protection.<\/p>\n
It should be noted that the UAE is a party to international conventions for the protection of copyrights, including the Berne Convention and the WIPO Copyright Treaty, which ensures mutual protection of works among member states.<\/p>\n
Integrated rights management system<\/p>\n
In addition to the technical and legislative aspect, the UAE is working to build an integrated system for the management of collective rights. In this context, the Emirates Music Rights Association (EMRA) has been registered as a local entity to manage collective rights in the music sector, a positive step towards enabling rights holders to collect their revenues in an orderly manner.<\/p>\n
The market for cloud digital rights protection platforms in the UAE is about $1.2 billion, driven by the growing demand for digital content protection and anti-piracy solutions, with growth expected to continue as digital content consumption expands and the media and entertainment sector flourishes.<\/p>\n
Challenges and opportunities for growth<\/p>\n
Despite the significant progress, there are still challenges facing the intellectual property protection system in the UAE, most notably:<\/p>\n
The inconsistency of enforcement procedures between the UAE: enforcement is carried out at the level of each emirate through three entities (police, economic, customs), with non-unified procedures.
\nLack of awareness: A survey indicated that only 40% of content creators in the UAE understand how to use digital rights protection platforms effectively.
\nHigh implementation costs: The cost of implementing cloud protection systems may exceed AED 500,000 for SMEs.<\/p>\n
